What is a QDRO?
A Qualified Domestic Relations Order (QDRO) is used
to allow payment from a retirement plan to a former spouse for
family law purposes (ie. alimony, child support or property
division.
How do I obtain a QDRO?
The first step is to have a Domestic Relations Order
(DRO) prepared and signed by a judge. The DRO will identify the
parties and instruct the retirement plan as to how much to pay to
the employee's spouse. Once signed by a judge, the DRO is submitted
to the plan administrator for qualification. The plan administrator
can approve or qualify the plan, making it a QDRO, and make the
payment as ordered by the court or the plan administrator may deny
qualification and a new order that meets the plan administrator's
requirements must be prepared.
